Why was the death penalty banned?
The court said the death penalty was a violation of the Eighth Amendment prohibition against cruel and unusual punishment because of the inconsistency in who was given a death sentence and who was not. The court suggested that new laws might be acceptable, if they provided clear standards for imposing death sentences.
Is lethal injection painless?
The protocol has been highly effective in producing a painless death, but the time required to cause death can be prolonged. Some patients have taken days to die, and a few patients have actually survived the process and have regained consciousness up to three days after taking the lethal dose.
Does the US still use the death penalty?
